CLINTON —
A Clinton County jury on Friday ordered a doctor to pay $1 million to a teen girl who claimed the care provider’s negligence in treating her asthma led to her having to have a tracheostomy.
Clinton resident Jessica Parks filed the civil lawsuit in Clinton County District Court in March 2007. Parks claimed Dr. Oduah Daniel Osaro of Clinton Urgent Care was negligent in delaying his treatment of her daughter, Kristie Neas, to the point that Neas had to have an emergency intubation during a 2005 hospital stay.
According to the suit, then-13-year-old Neas was taken to the emergency room in April 2005 for treatment of a severe asthma attack.
Osaro arrived about 21⁄2 hours after being notified of the girl’s condition and performed an emergency intubation on Neas in her hospital room, the lawsuit states.
Parks claimed in the lawsuit that Osaro negligently delayed a visit to the hospital “after being put on notice of Kristie Neas’ precarious condition.” The lawsuit claimed the intubation would not have been necessary had the girl’s “asthma condition been appropriately controlled.”
The emergency intubation led to the tracheostomy, scarring and permanent injuries to Neas’ trachea, according to the lawsuit.
The jury reached its verdict to award Neas and her mother with damages in the malpractice suit after a two-week trial.
