CLINTON —
A Clinton man will receive two suspended prison sentences for a theft and burglary from someone’s car.
Robert W. Johnson Jr., 21, 2162 Second Ave. South, was originally charged with second-degree robbery, interference with official acts and possession of drug paraphernalia, following an incident on Oct. 1. He pleaded guilty to first-degree theft and third-degree burglary on Dec. 6 and was sentenced last week.
According to court documents, Clinton police officers were sent to 608 Third Ave. South in reference to a burglary that had just occurred. According to the affidavit, Gary Petersen said he had caught two subjects inside his vehicle and they were running from his vehicle.
An officer observed two subjects in the 600 block alley between Fifth and Sixth avenues south, but they took off running after he attempted to make contact with them, according to court documents. After a short pursuit, they were both taken into custody. According to the affidavit, Johnson was told by the officer several times not to run and also resisted being handcuffed. Petersen identified Johnson, according to the affidavit.
Johnson was sentenced to 10 years in prison for first-degree theft and two years in prison for third-degree burglary. The incarceration will run concurrently, but is suspended. He will be required to complete two years of probation. Fines of $1,000 and $625 also were suspended. As part of his probation, Johnson must attend three Alcoholics Anonymous meetings a week, complete his GED and successfully complete the Residential Correctional Facility program.
