CLINTON —
Clinton County Assistant Attorney Ross Barlow has amended felony charges against Kyle Julian.
Barlow amended a robbery in the first degree charge to burglary in the second degree, a class C felony. Julian appeared in court Thursday and pleaded guilty to possession of a firearm as a felon and burglary in the second degree. At the time of his plea, he was 17, but had his 18th birthday on Sunday. Judge Nancy Tabor heard Julian’s plea.
According to court documents, Clinton police officers responded to a burglary complaint at 339 First Ave. on July 20 and learned that three assailants forced entry into an apartment occupied by two individuals. According to the affidavit, one of the occupants was assaulted and the subjects fled the scene with a small amount of money and other merchandise and jewelry. In a July 26 interview, one of the victims was able to identify Kyle Julian, who he has known for a period of time, according to court documents.
The firearm charge stems from a Sept. 19 arrest. According to court documents, Cpl. John Davis was traveling north on Fifth Street at Second Avenue South when he noticed two individuals running west in the 400 block of First Street. After making contact with the individuals, Davis identified one of them as Julian, according to the affidavit. Davis observed that Julian ran behind a red truck as he tried to leave. In that same location, Davis found a black and pink .380 hand gun, with the magazine next to the gun, according to the court documents.
According to the affidavit, the gun was obtained through a burglary at 933 N. Fourth St. However, the state agreed not to file any criminal charges relating to this burglary.
Julian admitted to these charges and pleaded guilty. Tabor accepted his plea and set his sentencing for 9 a.m. on Jan. 31.
